Account Termination & Suspension Policy

Important: This policy outlines Spark Triangle LLC's rights and procedures regarding account suspension and termination. We reserve the right to suspend or terminate accounts that violate our terms, policies, or applicable laws.

This Account Termination & Suspension Policy ("Policy") describes the circumstances under which Spark Triangle LLC ("Company," "we," "our," or "us") may suspend or terminate user accounts for the Ramakoti App, as well as the procedures and rights related to such actions.

1. Company's Right to Terminate

1.1 Our Rights

Spark Triangle LLC reserves the right, in its sole discretion, to suspend or terminate your account and access to the Ramakoti App at any time, with or without notice, for any reason, including but not limited to:

1.2 No Obligation to Provide Service

We are not obligated to provide service to any user and may refuse service to anyone at any time, with or without cause or notice.

2. Grounds for Termination

2.1 Policy Violations

Your account may be terminated for:

  • Violating our Terms of Service, Acceptable Use Policy, or End User License Agreement
  • Posting prohibited content (as defined in our Acceptable Use Policy)
  • Engaging in prohibited activities
  • Attempting to circumvent App restrictions or security measures

2.2 Illegal Activities

Immediate termination may occur for:

  • Engaging in illegal activities
  • Violating applicable laws or regulations
  • Infringing intellectual property rights
  • Engaging in fraud or deception

2.3 Security Violations

Your account may be terminated for:

  • Attempting to gain unauthorized access to the App or other users' accounts
  • Interfering with the App's security or functionality
  • Introducing malicious code or software
  • Sharing account credentials or allowing unauthorized access

2.4 Abuse and Harassment

Your account may be terminated for:

  • Harassing, threatening, or abusing other users
  • Posting harmful, defamatory, or hateful content
  • Engaging in spam or unsolicited communications
  • Creating multiple accounts to circumvent restrictions

2.5 Repeat Infringement

Accounts of users who repeatedly violate our policies or infringe upon intellectual property rights may be terminated in accordance with our DMCA & Copyright Policy.

3. Suspension vs. Termination

3.1 Account Suspension

Account suspension is a temporary restriction that:

  • Prevents access to the App for a specified period
  • May be lifted after review or resolution of the issue
  • Preserves account data during the suspension period
  • May be used as a warning before permanent termination

3.2 Account Termination

Account termination is permanent and:

  • Permanently revokes access to the App
  • Results in deletion of account data (subject to our Privacy Policy)
  • Prevents creation of new accounts by the same user (if we choose to enforce this)
  • Cannot be reversed except in exceptional circumstances

3.3 Our Discretion

We reserve the right to determine whether a violation warrants suspension or termination, and the duration of any suspension, in our sole discretion.

4. Termination Procedures

4.1 Notice Requirements

We may terminate your account:

  • With Notice: For most violations, we will attempt to provide notice before termination
  • Without Notice: For serious violations (illegal activity, fraud, security threats), we may terminate immediately without prior notice
  • Notice Method: Notice may be provided via email, in-app notification, or other reasonable means

4.2 Immediate Termination

We reserve the right to terminate accounts immediately, without prior notice, for serious violations including but not limited to illegal activities, fraud, security threats, or repeated policy violations.

5. User's Right to Delete Account

5.1 Voluntary Account Deletion

You may delete your account at any time by:

  • Using the account deletion feature in the App settings
  • Contacting us at support@ramakoti.app with a request for account deletion
  • Following the procedures outlined in our Privacy Policy

5.2 Data Deletion

When you delete your account, we will delete your personal data in accordance with our Privacy Policy. Some data may be retained for legal or operational purposes as described in our Privacy Policy.

6. Appeal Process

6.1 Right to Appeal

If you believe your account was suspended or terminated in error, you may submit an appeal by:

  • Emailing support@ramakoti.app with "Account Appeal" in the subject line
  • Providing your account information and a detailed explanation
  • Including any relevant evidence or documentation

6.2 Appeal Review

We will:

  • Review your appeal within 30 business days
  • Consider all relevant information and circumstances
  • Make a final decision in our sole discretion
  • Notify you of our decision via email

6.3 No Guarantee of Reinstatement

Submission of an appeal does not guarantee that your account will be reinstated. Our decision regarding appeals is final and binding.

7. Data Retention After Termination

7.1 Data Deletion

After account termination:

  • We will delete your personal data in accordance with our Privacy Policy
  • Deletion typically occurs within 90 days of termination
  • Some data may be retained for legal, regulatory, or operational purposes

7.2 Retained Data

We may retain certain data after termination for:

  • Legal compliance and regulatory requirements
  • Dispute resolution and enforcement of our rights
  • Prevention of fraud or abuse
  • Aggregated, anonymized data for analytics (cannot identify you)

7.3 Backup Data

Data in backup systems may be retained for longer periods but will be deleted in accordance with our data retention schedule.

8. Effect of Termination

8.1 Immediate Effects

Upon termination:

  • Your access to the App is immediately revoked
  • You may not create a new account without our permission
  • All licenses granted to you are terminated
  • You must immediately cease all use of the App

8.2 Surviving Provisions

Certain provisions of our Terms of Service, End User License Agreement, and other policies will survive termination, including but not limited to intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions.

9. Reinstatement

9.1 No Right to Reinstatement

There is no automatic right to account reinstatement after termination. Reinstatement, if granted, is at our sole discretion and may be subject to conditions.

9.2 Reinstatement Process

If you wish to request reinstatement, you may submit an appeal as described in Section 6. We will consider reinstatement requests on a case-by-case basis, but we are under no obligation to reinstate any terminated account.
