End User License Agreement

This End User License Agreement ("EULA" or "Agreement") governs your use of the Ramakoti mobile application (the "App" or "Software") provided by Spark Triangle LLC ("Company," "we," "our," or "us"). This EULA is a binding legal agreement between you ("User," "you," or "your") and Spark Triangle LLC.

1. License Grant

1.1 Grant of License

Subject to your compliance with this EULA, Spark Triangle LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on your personal mobile device(s) (smartphone or tablet)
• Use the App for your personal, non-commercial use in accordance with this EULA
• Access and use the features and services provided through the App

1.2 License Scope

This license is:

• Personal: Limited to your personal use only
• Non-Exclusive: We may grant similar licenses to other users
• Non-Transferable: You may not transfer, assign, or sublicense this license to any third party
• Revocable: We may revoke this license at any time for violation of this EULA
• Limited: Only for the specific purposes described in this EULA

2. License Restrictions

You agree NOT to:

• Copy or Reproduce: Copy, reproduce, duplicate, or create derivative works of the App or any portion thereof
• Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify: Modify, adapt, alter, translate, or create derivative works of the App
• Remove Notices: Remove, alter, or obscure any copyright, trademark, patent, or other proprietary notices from the App
• Commercial Use: Use the App for any commercial purpose, including but not limited to selling, renting, leasing, or licensing the App to third parties
• Automated Access: Use automated scripts, bots, crawlers, or other automated means to access or interact with the App
• Interfere: Interfere with or disrupt the App's functionality, servers, or networks
• Violate Laws: Use the App in violation of any applicable laws, regulations, or third-party rights
• Share Credentials: Share your account credentials or allow others to access your account
• Circumvent Security: Attempt to circumvent, disable, or interfere with security features of the App

3. Intellectual Property Rights

3.1 Ownership

The App, including all content, features, functionality, graphics, user interfaces, logos, trademarks, and all intellectual property rights therein, are owned by Spark Triangle LLC and its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

3.2 Reservation of Rights

All rights not expressly granted to you in this EULA are reserved by Spark Triangle LLC. This EULA does not grant you any rights to:

• Use our trademarks, service marks, or logos
• Reproduce, distribute, or display the App publicly
• Create derivative works based on the App
• Use the App in any manner not expressly permitted by this EULA

3.3 Trademarks

"Ramakoti," "Ramakoti App," and related marks are trademarks of Spark Triangle LLC. You may not use these trademarks without our prior written consent.

4. User Content and Data

4.1 Your Content

You retain ownership of any content, data, or information you create, upload, or store using the App ("User Content"). However, by using the App, you grant Spark Triangle LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

• Store, process, and display your User Content to provide the App's services
• Back up and synchronize your User Content across your devices
• Use your User Content for App functionality and service improvement

4.2 Data Privacy

Our collection, use, and protection of your personal information and data is governed by our Privacy Policy, which is incorporated into this EULA by reference.

5. Updates and Modifications

5.1 App Updates

Spark Triangle LLC may, from time to time, provide updates, upgrades, patches, or modifications to the App. These updates may:

• Add new features or functionality
• Fix bugs or security vulnerabilities
• Improve performance or user experience
• Modify or remove existing features

You may be required to install updates to continue using the App. Continued use of the App after an update constitutes acceptance of the updated App.

5.2 EULA Modifications

We reserve the right to modify this EULA at any time. Material changes will be communicated through the App or via email at least 30 days before they take effect. Your continued use of the App after changes become effective constitutes acceptance of the modified EULA.

6. Termination

6.1 Termination by You

You may terminate this EULA at any time by:

• Deleting the App from your device(s)
• Requesting account deletion through the App settings
• Contacting us at support@ramakoti.app

6.2 Termination by Company

We may terminate or suspend your license immediately, without prior notice, if:

• You breach any term of this EULA
• You violate our Acceptable Use Policy
• You engage in fraudulent, illegal, or harmful activities
• We are required to do so by law or court order
• We discontinue the App or any portion thereof

6.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You must immediately delete the App from all your devices
• We may delete your account and associated data in accordance with our Privacy Policy
• Sections of this EULA that by their nature should survive termination will survive

7. Warranty Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OR FREEDOM FROM VIRUSES OR MALWARE

We do not warrant that the App will meet your requirements, operate without interruption, be secure, or be error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPARK TRIANGLE LLC, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• LOSS OF GOODWILL OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid to us for the App (if any) in the twelve (12) months preceding the claim, or $10.00 USD, whichever is greater. Since the App is provided free of charge, our liability is limited to $10.00 USD.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Spark Triangle LLC, its affiliates, licensors, service providers, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the App
• Your violation of this EULA
• Your violation of any applicable laws or regulations
• Your infringement of any third-party rights
• Your User Content

10. Third-Party Services

The App may integrate with or use third-party services, including but not limited to:

• Google Firebase (authentication, database, analytics)
• Google AdMob (advertising)
• Other third-party services as described in our Privacy Policy

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. App Store Terms

11.1 App Store Acknowledgment

This EULA is between you and Spark Triangle LLC, not with the App Store (Apple App Store or Google Play Store). The App Store and its subsidiaries are third-party beneficiaries of this EULA and have the right to enforce it against you.

11.2 Apple App Store

If you downloaded the App from the Apple App Store:

• You acknowledge that Apple has no obligation to provide support or maintenance for the App
• In the event of App failure, you may notify Apple for a refund (subject to Apple's refund policy)
• You acknowledge that Apple is not responsible for addressing any claims relating to the App
• You acknowledge that Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claims

11.3 Google Play Store

If you downloaded the App from Google Play Store, you acknowledge that Google's terms and policies apply to your use of Google Play services.

12. Governing Law and Disputes

12.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of the United States and the State of [State], without regard to its conflict of law provisions. Any disputes arising from this EULA or the App shall be subject to the exclusive jurisdiction of the federal and state courts located in [State], United States.

12.2 Dispute Resolution

Before filing a claim, you agree to:

1. Contact us at support@ramakoti.app to attempt to resolve the dispute informally
2. If informal resolution fails, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
3. You waive any right to participate in a class-action lawsuit or class-wide arbitration

13. Miscellaneous

13.1 Entire Agreement

This EULA, together with our Privacy Policy, Terms of Service, and Acceptable Use Policy, constitutes the entire agreement between you and Spark Triangle LLC regarding the App and supersedes all prior agreements and understandings.

13.2 Severability

If any provision of this EULA is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any provision of this EULA does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer this EULA or your rights hereunder without our prior written consent. We may assign this EULA without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.
